A garden suite in Brampton is a small, separate home in your rear or side yard, either a stand-alone building or a unit above a detached garage. The City has allowed them since 2023 as part of its additional residential unit rules. Uptake has been slow: by October 2026 Brampton had registered 35 garden suites, against more than 30,000 properties with a registered basement or other attached unit.
The reason is mostly size and process. In most of the city a garden suite can be no larger than 35 m² (about 377 sq ft), and it needs two approvals: a planning review first, then a building permit. This guide covers every rule, the steps, the fees and what it really costs, with a checker for your own lot.

A rule change is under way
Brampton Council passed a new Comprehensive Zoning By-law, 14-2026, on February 4, 2026. It is under appeal at the Ontario Land Tribunal. Until the appeals are settled, the City applies both the old by-law (270-2004) and the new one, and the more restrictive provision wins. The City’s design guidelines for garden suites also show larger prototypes of 50 m² and 100 m², which may reflect where the rules are heading. For now, the numbers below are the safe ones to plan around. Confirm with zoning before you pay for drawings.
Who can build one
- House types: detached, semi-detached and townhouse lots.
- Units per lot: up to three homes including the main house. A garden suite works as house plus one basement unit plus the garden suite.
- Not allowed: on lots with a lodging house or supportive housing residence, in floodplain and open space zones, and in the Downtown floodplain area.
- Conservation land: if your lot is regulated by Credit Valley Conservation or the Toronto and Region Conservation Authority, you need their approval or the permit cannot proceed.
- No severing: the suite stays part of your property and cannot be split onto its own lot.

- Garage suites: the garage and suite together cannot exceed 96 m² or twice the garage floor area, whichever is less.
- Allowed projections: a bay window up to 0.6 m, eaves and gutters up to 0.5 m, and an open porch or deck up to 0.9 m into a setback.
- Lot coverage: the suite counts toward your zone’s lot coverage limit.
- Not allowed: balconies and rooftop patios.
- Converted shipping containers are permitted as garden suites.
The 1.2 metre path
The rule most likely to stop a Brampton garden suite is access. You need an unobstructed path at least 1.2 metres wide from the front wall of the house to the suite’s entrance, entirely on your own property. It is not required if the suite has direct access at least 1.2 m wide from a street or rear lane. On many newer Brampton lots the side yard is barely 1.2 m, and an air conditioner, gas meter or basement entrance stair can block it. Measure first.
Parking
A garden suite on its own needs no extra parking. If the lot will have two additional units, such as a basement apartment and a garden suite, one more parking space is required. It must be at least 2.6 m by 5.4 m, and tandem parking in the driveway is allowed.
Servicing
The suite connects to the house’s existing water and sewer services. If those need upgrading, the Region of Peel must approve it. Electrical work goes through the Electrical Safety Authority.

The process, step by step
Brampton is unusual: a garden suite needs a planning review before you can apply for a building permit.
Step 1: Check zoning and conservation status
Confirm your zone, your lot is not in a floodplain or open space zone, and whether CVC or TRCA regulates it. Email zoninginquiries@brampton.ca if you are unsure, and mention that you want a garden suite so they check both zoning by-laws.
Step 2: Custom Home / Garden Suite Review
Apply through BramPlanOnline. Urban Design, Zoning and Development Engineering review the proposal, Urban Design stamps the elevations, and Engineering sets grading securities. The fee is $530. The submission includes:
- Site plan, floor plans, elevations and roof plan
- A legal survey
- A grading and servicing plan
- Owner authorization
- Colour renderings
The City’s building page lists a $5,000 security deposit for grading, returned once the work is complete and approved.
Step 3: Building permit
Apply through the Brampton Building and Business Portal with:
- Schedule 1 designer information and the Applicable Law Checklist
- The site plan stamped by Zoning, Urban Design and Engineering from step 2
- Full architectural drawings, plus engineer-stamped truss and structural drawings where needed
- HVAC layout and heat loss calculations
- The water pipe sizing data sheet (2024 Building Code version)
- A grading plan by a professional engineer or Ontario Land Surveyor, and a surveyor-stamped survey
The City also notes that the builder must be licensed by the Home Construction Regulatory Authority and enrolled with Tarion, and that Tarion registration of the suite may be required. Ask your builder for both numbers before you sign.
Step 4: Pay charges before the permit is issued
Education development charges and cash-in-lieu of parkland are collected before the permit is issued. Ask admin.development@brampton.ca for the exact amounts for your suite.
Step 5: Build and pass inspections
Book each inspection through the portal. After two failed inspections in a row, a recall fee of $118.61 applies to each further visit.
Step 6: Registration and rental licence
The garden suite’s registration certificate is issued when occupancy is granted. You no longer need to email the ESA certificate. If you rent the suite, you also need a residential rental licence, covered below and in full in our Brampton rental licence guide.

For scale, a new single-detached home in Brampton pays $155,650 in development charges. The exemption is the biggest financial advantage a garden suite has.

Small suites cost more per square foot because the kitchen, bathroom, foundation and servicing are fixed costs spread over less space. Prefabricated and modular units, including converted shipping containers, can lower the building cost, but site work, servicing and approvals stay the same.
Paying for it
- Brampton’s Garden Suite Grant, which refunded municipal fees, closed on July 21, 2025. No replacement has been announced.
- Peel Region’s second unit renovation loans are on hold.
- The federal secondary suite loan announced in 2024 never opened.
- CMHC-insured refinancing since January 2025 allows up to 90 per cent of the home’s value after the suite is built, if under $2 million, with up to a 30-year amortization and an owner or relative living on the property. Confirm with your lender that a detached suite qualifies.
Rent and the rental licence
Average asking rents in Brampton in October 2026 were $1,696 for a studio, $1,862 for a one-bedroom and $2,345 for a two-bedroom (Zumper). A 35 m² garden suite is a studio or very compact one-bedroom, so expect studio to one-bedroom rents, with a premium for privacy and its own outdoor space. At $1,750 a month, a $200,000 suite earns about 10 per cent of its cost a year before expenses.
Since January 1, 2026, every rental property in Brampton needs a residential rental licence. It is free and renewed yearly. You need $2 million in liability insurance and must complete an online landlord education module. A property with a garden suite is licensed as a multi-unit rental. Operating without a licence carries fines of $750, $1,250 and $1,500 for repeat offences, and the City lists $1,000 to $1,500 for failing to register an additional unit.

Look for a deep lot, a side yard of at least 1.2 m clear on one side or rear lane access, and a lot outside conservation authority areas.
